ERISA Does Not Preempt State Law Claims

In Abraham v. Norcal Waste Systems, Inc., 9th Cir., No. 99-17040, 9/7/01), an appeals court overruled a lower court's decision that ERISA preempted a claim by shareholders (some of whom were also ESOP participants) against Norcal for defaulting on a loan.

Erratum

In the November-December issue of the Employee Ownership Report (our newsletter for members), the article on ISO and ESPP reporting indicates that the new reports required by the Tax Relief and Health Care Act of 2006 will be due in 2009. They actually will be due in 2008.

ERSOPs?

There has been some buzz lately (again) about something called an "ERSOP" (employee retirement stock ownership plan). Promoters are offering to install these tax-qualified plans, replete with an independent valuation, for as little as $4,000.
